Federal hemp policy is changing. Legislation enacted in November 2025 significantly changes the federal definition of hemp, including how THC is measured and which hemp-derived cannabinoid products may qualify as legal hemp. Under current law, those changes are scheduled to take effect November 12, 2026. Congress is considering legislation that could delay or modify implementation, but until further action becomes law, the November 12 effective date remains in place.

Why It’s Urgent

If the new federal hemp provisions take effect as currently scheduled, they could significantly reshape which hemp-derived products remain available to consumers and how those products are manufactured and sold.

The changes could:

• Limit access to full-spectrum and other hemp-derived cannabinoid products
• Create significant challenges for responsible hemp farmers, manufacturers, retailers, and small businesses
• Reduce consumer choice in the regulated marketplace
• Disrupt an industry still seeking clear, consistent federal standards
